COLUMBIA, SOUTH CAROLINA – Callison Tighe attorney Ian Duggan was co-counsel in the legal team that secured acquittals for two doctors accused of conspiracy to commit healthcare fraud.
On Thursday, August 23, 2018, a federal jury returned "not guilty" verdicts against Dr. John Pienkos, II and Dr. Alexander Tomovski. The Conway, SC, chiropractors were charged with conspiracy to commit healthcare fraud by the United States Attorney’s office in South Carolina on November 28, 2017. In addition to Duggan, Mark C. Moore of Nexsen Pruet represented Dr. Tomovski and Deborah B. Barbier represented Dr. Pienkos.
The two chiropractors were accused of conspiring to defraud BlueCross BlueShield of South Carolina of hundreds of thousands of dollars. More than 30 witnesses testified during the trial, including the chiropractors. The jury verdict came after an eight-day trial before the Honorable R. Bryan Harwell and almost nine hours of deliberations in U.S. District Court in Florence. According to The State newspaper, it’s one of the few cases the U.S. Attorney’s office in South Carolina has lost in recent years.
This case serves as a reminder that everyone in this country remains innocent until proven guilty. The investigation and resulting trial came at a great physical, emotional, and financial expense to the two men and their families.
