Mark C. Moore, Deborah B. Barbier and Ian T. Duggan secure acquittal in federal health care fraud case

COLUMBIA, S.C. – On Thursday, August 25, 2018, a federal jury returned a “Not Guilty” verdicts against Dr. John Pienkos, II and Dr. Alexander Tomovski. The Conway, South Carolina chiropractors were charged with conspiracy to commit health care fraud by the United States Attorney’s office in South Carolina on November 28, 2017.

Dr. Alexander Tomovski was represented by Mark Moore, leader of Nexsen Pruet’s White Collar Defense/Government Investigations practice, and Ian Duggan of Callison, Tighe and Robinson. Dr. John Pienkos was represented by Deborah Barbier.

During the eight-day trial, the jury heard Dr. Pienkos and Dr. Tomovski testify in their own defense, in addition to calling a number of patients to testify about the exceptional care they received at Conway Health Center and Allied Health. After hearing the testimony of more than 30 witnesses, the jury deliberated for approximately nine hours before returning the not guilty verdict.

Dr. Pienkos and Dr. Tomovski have maintained their innocence since the beginning of this case. The investigation of this matter and the trial have come at great physical, emotional and financial expense to these two men and their families.

This case serves as a reminder that everyone in this country is innocent until proven guilty. Dr. Pienkos and Dr. Tomovski appreciate the jury’s careful consideration of their case, as well as being vindicated by a jury of their peers.
