COLUMBIA, SC – Ashley Pennington, an attorney with more than 40 years’ experience in criminal law, has joined Burnette Shutt & McDaniel. He’ll focus his practice on civil rights cases, including issues involving jail reform.

Pennington’s interest in systemic reform stems from his time as a defense attorney. While serving as a public defender, he often worked to help clients find services, from housing assistance to employment that they needed to avoid future legal troubles.

“Ashley has spent decades doing everything in his power to stop the revolving door that leads people back to prison because they don’t have the help they need once they’re released,” Burnette Shutt & McDaniel co-founder Nekki Shutt said. “We’re pleased that he’s joined us in fighting for the reforms needed to slam that door shut forever.”

The former Ninth Circuit Public Defender (Charleston and Berkeley Counties), Pennington also volunteers with a prison re-entry initiative. Its goal was to help formerly incarcerated people successfully adjust to life outside prison.

Now that he’s in private practice, Pennington plans to focus on litigation aimed at fighting civil rights violations at the state and federal levels. This includes federal Section 1983 Civil Rights lawsuits and South Carolina Tort Claims actions involving excessive police force and police-involved shootings.

He also is very interested in cases addressing prisoner mental health issues and needed reforms. Burnette Shutt & McDaniel attorneys Stuart Andrews, Nekki Shutt and Sarah Cox currently are representing prisoners in just such a case challenging conditions at the Richland County jail.

That federal lawsuit contends that detainees with serious mental illnesses are subjected to inhumane and unconstitutional treatment at the overcrowded, understaffed facility.

Pennington’s long-standing commitment to improve mental health programs for incarcerated individuals will complement this and similar litigation Andrews has brought against the Charleston County Detention Center and the SC Department of Corrections.
